Identifying the determinants of human behavior is useful to adjust interventions and lead the civil society toward a stronger commitment to climate change mitigation and adaptation objectives, achieving greater support for successfully implementing environmental policies. Existing research has largely focused on case studies of pro-environmental behaviors in developed economies but there is very little evidence for developing countries. This study provides estimations of the effect of internal factors, such as sociodemographic variables, and four psychological dimensions on PEBs. Data were obtained (...) through a survey applied with future decision makers – university students – from Colombia and Nicaragua. Indices were generated for PEBs and the psychological dimensions using z-scores and Principal Component Analysis. Partial correlations were evaluated through the Ordinary Least Squares method. Our results suggest that, in order to reach the planned emission reduction targets, policy approaches should more strongly focus on educating and motivating citizens and prepare them for contributing to the environmental cause, as well as provide individual solutions to combat CC, rather than providing only information on its causes and consequences. La pena natural es una situación paradójica que se puede presentar cuando el autor de un delito, al cometerlo o a causa de éste, ha sufrido un daño igual o mayor al que padecería si el juez de la causa le aplicara la pena estatal prevista para tal conducta. Se da con frecuencia al juzgar ciertos accidentes viales, cuando el acusado ya carga el peso de ser quien, por imprudencia, mató a su pareja o familiar cercano, por ejemplo. Pero ¿en (...) qué situaciones y cómo cabe recurrir a la pena natural? En esta investigación, Manuel Serrano explora las diversas aristas y posturas en pugna que atraviesan este tema, donde se cruzan cuestiones como la idea de la “culpa compensada”, la prohibición de aplicar castigo doble por un mismo hecho (non bis in idem) y la clemencia judicial. El autor desmonta la estructura conceptual de la pena natural, estudia jurisprudencia argentina y recorre producciones teóricas de juristas que se han preocupado por este asunto complejo, profundo y poco abordado del derecho penal. El trabajo consiste en una elucidación de los elementos que conforman el concepto de pena natural (poena naturalis) en el Derecho penal. Se puede caracterizar la pena natural como el daño o sufrimiento que recae sobre el autor de un delito, producto de la comisión del mismo, que debe ser descontado de la pena legal que ha de aplicársele. Si bien existe un mínimo acuerdo sobre esto, tanto en la jurisprudencia como en la doctrina penal se observan serios desacuerdos acerca (...) de los requisitos que se deben cumplir para reconocer que se está frente a una pena natural. Para elucidar los elementos, se utilizará el constructivismo conceptual de Ronald Dworkin, a fin de describir el desacuerdo y sus implicancias, reconocer los elementos principales de la pena natural y justificarlos bajo su mejor luz moral. ABSTRACT This study focuses on the clarification of the conceptual elements of poena naturalis in criminal law settings. The poena naturalis is the damage or suffering that falls on the convict for its commission. This damage must be deducted from the poena forensis to be applied. Although there is a minimum agreement about the concept of poena naturalis, in the jurisprudence and among legal scholars, there are serious disagreements about the elements of poena naturalis. To elucidate the elements, I will adopt Ronald Dworkin’s conceptual constructivism to describe the disagreement and its implications. La mal llamada “Conquista del Desierto” constituyó una serie de campañas militares ocurridas en el actual territorio patagónico argentino entre los años 1878 y 1885 cuyo resultado fue el asesinato, la violación y sometimiento a la esclavitud de diversos pueblos y comunidades indígenas. Este no fue un caso aislado, sino que se suma a una serie de ataques sistemáticos que han sufrido los indígenas en la Argentina. En los últimos años, a raíz del reclamo y las luchas de los pueblos (...) y comunidades indígenas, así como también de las organizaciones de derechos humanos, se han comenzado a juzgar algunos de estos hechos. En particular, la Masacre de Napalpí (1924) y la Masacre de La Bomba (1947) fueron los primeros que lograron respuestas judiciales favorables. En ambos se determinó que el accionar estatal era constitutivo de un genocidio y, por lo tanto, se debía resarcir a las comunidades actuales. Ahora bien, la Campaña del Desierto, al día de hoy, no tiene respuesta por parte del Estado. Teniendo presente este panorama, nuestro objetivo en este trabajo es reconstruir los diferentes problemas que enfrenta la posibilidad del reclamo judicial. Para ello, comenzaremos describiendo en qué consistió la Campaña del Desierto. Luego, explicaremos la noción de genocidio aplicado a hechos de injusticias históricas. Como tercer paso, reconstruiremos los casos jurisprudenciales que se han preocupado por genocidios indígenas ocurridos en el pasado. Con este panorama revelado, nos enfocaremos en los diferentes problemas jurídicos y políticos que surgen en los reclamos de justicia. (shrink)

En la literatura jurídico penal, el arrepentimiento cobra relevancia en un lugar específico: la condena, más precisamente, en la determinación de la pena del sujeto que ha sido encontrado responsable por la comisión de un delito y que, a su vez, se encuentra arrepentido por su accionar. Desde la concepción comunicativa del castigo, en este trabajo contestaré las siguientes preguntas: ¿El arrepentimiento significa un menor reproche penal o es indiferente para la determinación de la pena? en caso de que implique (...) un acercamiento al castigo mínimo establecido en la legislación ¿Cuándo es razonable que esto suceda? In the present work I am interested in addressing a specific aspect within the conceptual problem that poena naturalis implies. In other words, here I will answer the question about what is the poena naturalis. We can be recognized three theories: one that affirms that the poena naturalis is a compensation for culpability, another according to which the poena naturalis is the product of clemency or compassion, and the last that defends that the principles of legality, proportionality and rationality allow (...) justifying the poena naturalis. I will stop at each one of them in order to carry out a critical examination that will allow me to conclude which is the conception that best supports natural punishment. (shrink)

La doctrina establecida por la Corte Suprema de Justicia de la Argentina en relación a los crímenes de lesa humanidad cometidos durante la última dictadura militar, expresamente declaraba la obligación del Estado de investigar y juzgar a los responsables de su comisión. La Corte no sólo caracterizó dichos delitos, sino que también estableció que no eran susceptibles de amnistía, indulto, ni prescripción. Pero, en el año 2017 dictó el fallo “Muiña” donde, por voto mayoritario, decidió otorgarle el beneficio del “2 (...) por 1” a un condenado por dichos delitos. La consecuencia fue su inmediata libertad por el vencimiento de la condena. La respuesta de la sociedad fue clara. Con diversas manifestaciones, la sociedad civil, las instituciones y las personalidades públicas se declararon en contra de la sentencia. Más aún, del voto de los mismos jueces se observan expresiones que denotan un gran pesar a la hora de tomar la decisión. Más precisamente, sostenían estar ante un dilema. En este trabajo, lejos de realizar un análisis de la interpretación jurídica que se efectuó en la sentencia, se propone trabajar sobre el concepto de dilema y la posibilidad de aplicación en el presente caso. La finalidad concreta es indagar si se está ante un dilema y en su caso si los jueces utilizan este concepto como un arma argumentativa para lograr adhesión o compasión de la opinión pública. En este sentido, se comenzará relatando el marco jurídico del fallo, donde se describirá la historia judicial de Muiña y los argumentos dados por el voto mayoritario y el minoritario de la Corte. Luego, se realizará un análisis del concepto de dilema, para reconstruirlo sobre la base de dos grandes posturas: Una lógica conceptual y otra fenomenológica. Posteriormente, se realizará un examen de la dimensión institucional del derecho y la moralidad judicial, para - finalmente - poder intentar responder si se está efectivamente ante un dilema. Malem Seña in “¿Puede las malas personas ser buenos jueces?” analyzed the judicial morality. At first time from a historical analysis, the judges were not required to base their judgments, because they were the mirror of legitimacy and morality of their decisions. With the advent of rationalism and modern State, the sentences should be the foundation. The situation that put the judge person in the background. In this situation, the answer to the question posed in the job would be: "Yes, (...) bad people can be good judges", answer hardly accepted by all. Malem Seña, far from giving a definite answer, ends his work with the insinuation that judges should maintain an image of morality, rather than being morally unimpeachable agents. This situation raises questions about different dimensions of analysis that have been shelved, and in particular try to analyze why this importance takes the image of morality. To do this, from the perspective of the concepts of Slavoj Žižek‘s ideology and fantasy, it will attempt to reach some responses or generate argumentative lines about the importance of the image of morality on morality itself. There is a close relationship between education and citizenship. Liberal political theorists tend to spend much of their work justifying the role of educational institutions in political communities. However, the development of these proposals is usually thought for subjects who do not have disabilities, arbitrarily excluding a significant proportion of society. This not only happens at an educational level, it is replicated in various areas of social life. In this sense, in the present work I am going to propose that (...) the adequacy approach proposed by Debra Satz is extremely valuable to think about the educational equity of people with disabilities. The choice is not accidental or arbitrary. Satz is a renowned philosopher whose interest in education and its importance in forming citizens for diverse and plural societies. To do this, I will begin by presenting three possible models of special education: the special school, integration and inclusion. Then the two paradigms that prevail in the characterization of disability will be addressed: the social model and the medical model. Instead, I will reconstruct the third proposal elaborated by Satz in order to evaluate with which inclusive education model and disability paradigm it is compatible and why it is presented as a valuable proposal in this field. Our purpose is to describe the application of legitimate defense in so-called non-confrontational situations. To do this, we will conceptualize gender violence as that which against women, due to their condition as such, and we will describe the absence by the courts in the identification of this problem. Second, we will analyze the reception of Argentine and international legislation on the treatment of gender violence and the recommendations and criteria to take into account when interpreting and applying criminal law. Finally, (...) we will present the treatment of legitimate defense in contexts of gender violence, analyzing each of its elements. Our conclusions will focus on the need to address situations of gender violence based on international regulations for the application of legitimate defense in non-confrontational situations. José Otero Espasandín (1900-1987) was an important science popularizer in Argentina during the 1940´s, who belonged to the Misiones Pedagógicas (Educational Missions) group in Spain. This paper presents his biography and his work as a science and technology popularizer. It focused on his features, value and significance for that period.

Se analizan en este artículo una serie de revistas y libros, así como otro tipo de manifestaciones producidas en España en el período 1968-1976, que se refirieron a la denominada crítica de la ciencia. Este movimiento tuvo su mayor vigencia en los países occidentales en la década de los setenta del pasado siglo. El análisis muestra la presencia de esta crítica en diferentes medios, aun cuando se puede considerar que su relevancia fue relativamente minoritaria en el conjunto de la sociedad (...) española. The aim of this paper is to analyze a selection of arguments used by the Argentine Supreme Court to reduce the sentence of individuals convicted of crimes against humanity. The focus will be primarily centered on “Muiña´s case”, in which a lenient outdated ruling was made. The questions that this work will try to answer revolve around the court´s merit in issuing this lenient ruling to Muiña´s case and its justification. First, Muiña´s case is analyzed in depth. Then, a critical (...) analysis about the ruling and a decision concerning the existence of a true justification will be developed. Finally, we will discuss the appropriateness of the Court’s decision in Muiña´s case as opposed to the decision made in “Batalla´s case”, in which a less beneficial law was applied retroactively. In this paper, we analyze the origin of the links between global bioethics (which we differentiate from biomedical bioethics) and human rights. We understand that we are in a global civilizational crisis, whose roots extend to 1492 today, in which the modern-capitalist model used the discourse of human rights to justify its predatory technocracy. There are three theoretical assumptions that support our analysis: 1) The current conditions in which the technique shows its destructive power over nature (Anthropocene) indicate that none (...) of the ethical antecedents are applicable to such circumstances. In this new context, the kantian categorical imperative has been reconverted into a moral and political duty to not instrumentalize either human beings or nature. We call this new ethical consideration bioethics. 2) The current geopolitical composition of the world must be thought in terms of the global North and the global South, as two regions that are forged in the midst of important processes of globalization of the world-system, and whose main consequence lies in the absence of equity in the distribution of wealth and well-being between the two. 3) The current environmental crisis or climate change, the product of an economic model based on extractive technology, has become one of the most serious threats against human rights. Este artículo se adentra en los temas y tópicos vitales de la obra literaria de Eliacer Cansino, escritor dedicado a la literatura juvenil, e invita a reflexionar sobre cómo su lectura puede desarrollar el pensamiento crítico de los jóvenes lectores del siglo XXI. Para abordar esta investigación, se ha recurrido a una metodología de corte cualitativo, con especial atención a la narrativa biográfica. De esta manera, dado que literatura y realidad constituyen dos caras de una moneda al forjar lectores, se (...) analizó el perimundo literario de Eliacer Cansino. In this paper we prove that the free algebras in a subvariety equation image of the variety equation image of semi-Heyting algebras are directly decomposable if and only if equation image satisfies the Stone identity.

Adults (more than 18 years old) are likely to reproduce the habits that they acquired during childhood and adolescence (from 6 to 16 years old). For that reason, teachers and parents have the responsibility to promote an active and healthy lifestyle in children and adolescents. Even though every school subject should promote healthy activities, Physical Education (PE) is the most important subject to foster well-being habits associated to healthy lifestyle during sport practice and other kinds of active tasks. Indeed, there (...) are many factors that influence the acquisition of healthy habits that should be taken into account when programs and activities are implemented in both educational and extracurricular context. In this sense, psychological and social factors are of utmost importance to achieve optimal experiences for an active and healthy lifestyle. However, due to the myriad of studies analyzing different factors in different contexts, there could be confusion when programs and pedagogical strategies are applied in educational or extracurricular contexts. The objective of this investigation is to analyze the state of art of the psychosocial factors which influence the engagement in physical activities and sport practice. The keywords used in this review were mainly: ‘Self-Determination Theory’, ‘motivation’, ‘Psychological need satisfaction, ‘physical activity and sport engagement’, ‘Elementary Education’, ‘Secondary Education’, ‘Physical Education’. The articles were selected according to the following criteria: (a) peer-reviewed original research published in international journals indexed in JCR or SJR, (b) published in English or Spanish, (c) about psychosocial factors which influence the physical activity and sport engagement, (b) in educational or extracurricular context. Research articles selected were found through nine databases. It was observed that physical activities and sport practice engagement are closely related to psychological factors. In particularly, intrinsic motivation was able to determine the active participation in any activity, including physical activity and sport practice during the implementation of Small-Sided Games and other kinds of pedagogical strategies (e.g., Pedagogical Models). Motivation was also closely related to flow state. Finally, these variables should be considered in order to organize effective programs to promote an active and healthy lifestyle in Physical Education classes. (shrink)

This paper is devoted to the study of some subvarieties of the variety Q of Q-Heyting algebras, that is, Heyting algebras with a quantifier. In particular, a deeper investigation is carried out in the variety Q subscript 3 of three-valued Q-Heyting algebras to show that the structure of the lattice of subvarieties of Q is far more complicated that the lattice of subvarieties of Heyting algebras. We determine the simple and subdirectly irreducible algebras in Q subscript 3 and we construct (...) the lattice of subvarieties lambda (Q subscript 3) of the variety Q subscript 3. (shrink)

The variety O2 of double Ockham algebras consists of the algebras (A ∨, ∧, f,g 0,1) of type (2,2,1,1,0,0) where (A; ∨, ∧,f, 0,1) and (A; ∨, ∧,g 0,1) are Ockham algebras. In [16], M. Sequeira introduced several subvarieties of O2. In this paper we give a construction of free double Ockham algebras on a partially ordered set. We also describe free objects for the subvarieties of O2 considered in [16].

In this work we provide a new topological representation for implication algebras in such a way that its one-point compactification is the topological space given in [1]. Some applications are given thereof.

In this article, we examine scholarly analyses of justice and develop a framework that can help assess the claims from the parties in the Russian state-led doping scandal, including, but not limited to, Russian athletes, non-Russian athletes, the World Anti-Doping Agency, and sport governing bodies. The two key components of this justice framework are pluralism and relationality/contextuality. We argue that a justice framework built upon these elements better captures the nature of justice. We conclude that no party in the Russian (...) state-led doping case has exclusive access to justice. Rather, all the parties have legitimate calls for justice against one another. Thus, the administration of justice will fail to serve justice, in its different meanings, for all parties. (shrink)

Hospitality can be considered a key institution in the social relationships in the ancient Mediterranean. To identify the people involved in a hospitality agreement, in certain contexts small objects were used in a similar way to a password, which the Greeks called symbolon and the Romans tessera hospitalis. We know how the latter were used thanks to Plautus' Poenulus. At least 64 pieces are currently known which may be identified as tesserae hospitales. All come from the Western Mediterranean. The majority (...) contain brief inscriptions, written in Etruscan, Latin, Greek, or Celtiberian. They share a series of common features, which impart a clear family resemblance beyond geographic, cultural, or linguistic borders. (shrink)

This paper analyses the details that characterized the negotiation and collection of the servicio de los naturales from the year 1603 onwards, the last time of those three in which moriscos of Granada paid to the Hispanic Monarchy after the Alpujarras War, when they were settled in Castile. The author has analysed documents coming from the Archivo General de Simancas, but also those included in notary’s protocols and in local archives. Its main contributions are three: to publish the content of (...) the actual contract signed by the moriscos and the Crown; to contribute to set up a precise spatial distribution of the communities that paid the tax and, finally, to show the amounts delivered by them. Irregularities, problems, and conflicts lived while the precedent servicios were being paid, are analysed too. There are aspects that we know thanks to other previous works. Nevertheless, if they are considered in relation with the situation of the year 1603, they allow observing that all those difficulties were used in order to improve the servicio itself and the agreement between the minority and the King. The current economic crisis, unsustainable growth, and financial scandals invite reflection on the role of universities in professional training, particularly those who have to manage businesses. This study analyzes the main factors that might determine the extent to which Spanish organizational management educators use corporate social responsibility (CSR) or business ethics stand-alone subjects to equip students with alternative views on business. A web content analysis and non-parametric mean comparison statistics of the curricula of undergraduate degrees in all universities in Spain (...) were conducted. The main conclusion of this paper is related to the Bologna effect in Spanish universities. Comparing our results with prior research in this matter, it is demonstrated that the main reason that explains the increase of CSR and ethical education in Spain is the Bologna process and its adaptation to the European Higher Education Area. Also, private universities in Spain are more likely to require an ethics course than public universities. Other factors, such as size, political orientation, or related to CSR chairs are not statistically explanatory of CSR and ethical education. (shrink)

El artículo plantea una reflexión acerca del alcance y el impacto de las políticas de desarrollo rural en la juventud andaluza, a través de los resultados que arroja la línea de investigación en ese ámbito que los autores han desarrollado en los últimos años. Esta ilustra sobre el contexto, las expectativas y las representaciones de la juventud —a menudo negativas—, desde los tiempos posteriores a la gran recesión iniciada en el 2008 hasta la actualidad. Asimismo, se recoge la perspectiva de (...) los gestores de tales políticas y se muestran los resultados de dos experiencias dirigidas a aumentar la participación de la juventud y su integración con las estructuras del desarrollo rural. Todo ello evidencia el limitado impacto que percibe la juventud, así como las dificultades y las inconsistencias a las que se enfrentan las políticas de desarrollo rural para revertir tal situación, pese al potencial que encierran y a sus logros en otros momentos y ámbitos. : La obra de Andrés Pérez de Rivas considera la pobreza desde cuatro perspectivas: la pobreza económica, el aislamiento y la barbarie, la ignorancia de la fe cristina y la santa pobreza. Tratándose de los indígenas americanos, en ningún caso aparece la pobreza como injusticia o como el resultado de la injusticia. No hay una denuncia o crítica de contenido social. Pérez de Rivas está hablando de un ser vulnerable, desprotegido y, por lo tanto, de un menor, un necesitado de (...) ayuda, un dependiente. Lo que sí hay es un proyecto para superar esta situación de precariedad, barbarie y paganismo; proyecto que se constituye en un discurso de legitimación del hecho colonial. Este discurso, contenido principalmente en Historia de los triunfos de nuestra santa fe, es el objeto de estudio del presente artículo. (shrink)

The objective of this paper is analyzing to which extent the multiverse hypothesis provides a real explanation of the peculiarities of the laws and constants in our universe. First we argue in favor of the thesis that all multiverses except Tegmark’s “mathematical multiverse” are too small to explain the fine tuning, so that they merely shift the problem up one level. But the “mathematical multiverse" is surely too large. To prove this assessment, we have performed a number of experiments with (...) cellular automata of complex behavior, which can be considered as universes in the mathematical multiverse. The analogy between what happens in some automata (in particular Conway’s “Game of Life") and the real world is very strong. But if the results of our experiments can be extrapolated to our universe, we should expect to inhabit—in the context of the multiverse—a world in which at least some of the laws and constants of nature should show a certain time dependence. Actually, the probability of our existence in a world such as ours would be mathematically equal to zero. In consequence, the results presented in this paper can be considered as an inkling that the hypothesis of the multiverse, whatever its type, does not offer an adequate explanation for the peculiarities of the physical laws in our world. Este ensayo es consecuencia de las reflexiones que desde hace años realizamos en el Instituto de Paz y Conflictos de la Universidad de Granada y que nos ha obligado a hacer una deconstrucción crítica de algunos aspectos del pensamiento pacifista. Bien es cierto que la supervivencia de la especie ha sido posible porque la respuesta a la conflictividad ha sido, mayoritariamente, la búsqueda de equilibrios dinámicos y de armonía. Pero, a pesar de todo, perviven muchas grietas, rupturas, dadas por la (...) propia contingencia y fragilidad humanas. Estamos ante unos entes humanos fragmentados, violentados, lo que hace más difícil la búsqueda de la armonía o la paz. Estas dificultades son razones de peso para trabajar en el camino de una «desfragmentación» ontológica que sea útil para liberar nuestras fuerzas emancipadoras y creativas. Construir la visión integrada y unitaria de la Ciencia de los Seres Humanos es una tarea conjunta que interesa sobremanera a la Investigación para la Paz.This essay is a consequence of the reflections we have been conducting for several years at the Instituto de Paz y Conflictos of the University of Granada. These reflections have obliged us to undertake a critical deconstruction of a few aspects of pacifist thought. Although the survival of the species has been possible because the response to conflicts has been, principally, the search for dynamic equilibrium and harmony; on the other hand there remain many fissures, ruptures brought about by the own human contingency and fragility. We find ourselves before a fragmented and distorted human being, which makes the search for harmony or peace even more difficult. These difficulties are convincing reasons for working towards an ontological “defragmentation” which is useful to liberate our emancipating and creative forces. To build the integrated and united view of Human Sciences is a collective task which is of great interest for Peace Research. (shrink)
